TERMS AND CONDITIONS (Terms)
1. These terms and conditions govern the participation in this Canon Advantage Chance to Win Program (Competition) Information and instructions on how to participate form part of these Terms.
2. Participation in the Competition is deemed acceptance of these Terms.
3. This Competition starts at 9:00am NZST on 01/03/2025 and ends at 5:00pm NZST on 30/04/2025 (Competition Period).
4. This Competition requires Participants to complete 3 plans in the ‘Canon Advantage product training program’ (Training Plan) by the last day of the Competition Period.
Eligibility
5. This Competition is only open to individual New Zealand residents who are:
a. Employees and contractors who are engaged in a sales role, customer service role or retail management role in the selected Photo Specialty retailers (Retail Partners) that have successfully enrolled to the Canon Advantage training portal (Participants)
b. Participants who are under the age of 18 must have the written consent of their parent or legal guardian to enter this Competition.
c. To be eligible to enter, Participants must complete 3 training plans (Training Plan) during the Competition Period.
d. Upon fulfilling the Eligibility criteria listed in this clause 5 Participants will receive one automatic entry only.
6. By promoting this Competition to Participants, the Retail Partners agree to be bound by these Terms and ensure the Participants are also bound.
How to Enter
7. From 01/03/2025 the Promoter will announce the Competition through:
Promotional materials displayed at the Retail Partner’s in-store location, and a video on the training platform.
8. Each Participant’s Entry to the Competition is automatic subject to the Participant fulfilling the Eligibility criteria listed under clause 5 (Entry).
9. Participants consent to receiving marketing communications and information from Promoter regarding the latest offers and promotions of Canon products and services. Participants may opt out of communications at any time.
Judging
10. This Competition is a game of chance and the Winners will be selected via a random draw.
11. The first 25 entries drawn will be awarded with a Canon Puffer Jacket (Winners)
12. The total Prize pool is valued at $4,598.75
13. The Promoter's decision is final, and no correspondence will be entered into.
14. No responsibility is accepted for any Entry that is late, lost or misdirected, or if a Winner does not claim their Prize in accordance with these Terms.
Prizes
15. The 25 Winners will receive a Canon Puffer Jacket valued at $183.95 (NZD) RRP (Gift).
Claiming the Prize
16. A draw will take place at 5pm NZST on 7/5/2025 at the head office of the Promoter at of 28 The Warehouse Way, Northcote, Auckland, subject to any directions from a regulatory authority.
17. The first 25 valid entries drawn will be the Winners
18. The Winners will be notified by 7pm (NZST) on 18/5/2025
Prize Processing:
The Promoter will
a. Contact winners through local Canon field representatives. Canon field representatives will obtain the email addresses and delivery address from the Winners for Prize processing. All Winners will be notified in writing within seven (7) days of the draw taking place.
b. The Promoter will send the individual Prize to the address provided by the Winner’s via registered New Zealand Post or will be delivered by the Promoter’s local field representatives.
c. The Promoter will send a tracking number to the individual Winner within 14 business days and the Winner agrees to acknowledge delivery of the Prize by signing an acknowledgement of receipt.
d. The Promoter has no control of and is not responsible for any delays or issues arising from the use of New Zealand Post.
19. The names of the Winners will be given to the Retail Partner’s head office and each Winner consents to the Retail Partner and Promotor publishing their name in an announcement on the Canon Advantage platform.
20. The Winners must provide their names and email addresses and delivery addresses to claim the Prizes to Canon field team representative via written confirmation.
21. If the Winner:
a. does not, within 14 days of the Prize being drawn, claim their Prize according to the instructions specified in the Promoter’s email (including by not providing a correct email address or delivery address for the Prize to be delivered to by the stated due date); or
b. cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the Prize in its entirety and the Promoter will choose an alternate Winner at random via a draw from the rest of the Entries at their sole discretion.
22. If a Winner forfeits the Prize, a secondary draw may take place at 5pm NZST on 30/5/2025 at the head office of the Promoter at of 28 The Warehouse Way, Northcote, Auckland, subject to any directions from a regulatory authority.
Participant’s Warranties and Indemnity
23. The Promoter is not liable for any costs and claims in connection with a failure by itself to comply with these Terms.
24. Each Participant agrees that they are fully responsible for each Entry they submit. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by the Participant in submitting their Entry.
25. This Competition is in no way endorsed, sponsored or affiliated with Myagi Software. The Promoter is not liable for any costs and claims arising in connection with a failure by Myagi Software service provider to comply with these Terms, or otherwise arising in connection with this Competition.
26. Participants agree the Prize may be regarded as benefits inkind and be liable to taxes, including fringe benefits tax. Participants and their employer are liable for all such taxes. The Promoter recommends Participants and the Retail Partner obtain independent tax advice in this regard.
27. By accepting these Terms, the Participants confirm they have reviewed and accepted the policies, terms and conditions of Myagi software.
Conditions that may Invalidate Entries, Participants or the Competition
28. The Promoter reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.
29. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
a. to disqualify any Participant; or
b. modify, suspend, terminate, or cancel the Competition as appropriate.
30. The Promoter reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Terms.
31. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Privacy
32. The Promoter collects personal information in order to conduct this Competition. The Promoter may, for the purpose of conducting this Competition, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.
33. Information about Participants may be published as set out in these Terms. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (www.canon.co.nz/Privacy-Policy).
Liability
34. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993 or similar consumer protection laws in New Zealand (Non-Excludable Guarantees).
35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Participant; or (e) use of the Gift.
General
36. These Terms may change, and the Promoter will inform Participants of any changes as soon as reasonably possible.
37. The Promoter will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays or delays in bank processing.
38. All money amounts in these Terms are in New Zealand Dollars inclusive of GST.
39. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.
